James D. Silver joined Conrad Scherer in 2007 from Carlton Fields, P.A., where he headed the firm’s Miami bankruptcy practice. An AV rated attorney, Mr. Silver’s practice focuses on business bankruptcy and insolvency work and creditors rights, including extensive litigation relating to those matters. Mr. Silver also has a background as an SEC Receiver and with various litigation, fraud investigation, and asset tracing in connection with SEC Receivership matters. Mr. Silver also handles commercial litigation matters.

In 2006, Mr. Silver was appointed Receiver by the U.S. District Court, Middle District of Florida, in connection with an S.E.C. Enforcement Action involving a $20 million plus ponzi scheme and the fraudulent sale of unregistered securities. Mr. Silver has represented secured and unsecured creditors in assignments for the benefit of creditors, has prosecuted and defended fraudulent transfer and preference litigation, and has represented creditors litigating objections to discharge and the dischargeability of particular debts. Mr. Silver has also litigated various contempt issues, having successfully obtained orders to show cause, writs of bodily attachment, and orders providing for the incarceration of the contemnor.

At the University of Miami School of Law, where he graduated in the top three percent of his class, Mr. Silver was associate research editor of the University of Miami Law Review. In 2007, he was listed as a top bankruptcy lawyer in the South Florida Legal Guide’s Top Lawyers.
